Holding the Home Office to Account

Judicial review allows the courts to examine whether a public authority such as the Home Office has acted unlawfully. It is available where the Home Office has refused to treat a submission as a fresh claim under paragraph 353, failed to follow proper procedures, or made a decision that is irrational or contrary to established law.

Before issuing proceedings, a Pre-Action Protocol (PAP) letter is sent to the Home Office. This sets out the legal challenge and gives the Home Office an opportunity to reconsider. Many cases resolve at this stage without court proceedings.
